Who Decides My Case?

A workers’ compensation case is not decided by a judge. Instead, a Workers’ Compensation Commissioner presides over and makes the final ruling on your case.

In South Carolina, the Workers’ Compensation Commission consists of seven commissioners appointed by the Governor. These commissioners are considered by and approved of by the Senate before serving their six year terms. The Commission Chairman is also chosen by the Governor to be the chief executive officer of the Commission and is responsible for implementing the Commissions’ policies. Serving a two year term, a new Chairman is chosen every two years.
